Contractor shall have no liability for claims of patent, trade secret, or copyright infringement based on the use of Deliverables combined with other materials not provided by Contractor so that Contractor is not held responsible for external factors causing infringement.

Contractor shall have no liability or obligation for any claim of patent, trade secret or copyright infringement based on: (a) use of a combination of a Deliverable, or portion thereof, with other materials not provided by Contractor, where such combination causes such infringement. Contractor shall have no liability or obligation for any claim of patent, trade secret or copyright infringement based on: (b) use of the Deliverable, or portion thereof, not in accordance with this Agreement or for purposes not intended by Contractor. Contractor shall have no liability or obligation for any claim of patent, trade secret or copyright infringement based on: (c) any modification of the Deliverable, or portion thereof, by any person other than Contractor.
